IEP/504 Process

The Individualized Education Program (IEP), as provide for in the Individuals with Disabilities Education Act (IDEA) is an essential document for a child with special needs.  A guide to the IEP process is available at the U.S. Deptarment of Education’s web site.  The Learning Disabilities Association of America also has an excellent examination of the process of developing and implementing the IEP and tips on preparing for a successful IEP meeting.  The Education Law Center also provides information parents need to understand the IEP/504 process in Pennsylvania.

This video link is about the California IEP process, but the PA process is almost identical so it might be helpful for parents new to IEPs.

Section 504 of the Rehabilitation Act of 1973 is a civil rights law prohibiting discrimination based upon disability.  It allows for accommodations and modifications so that students with disabilities can receive an education that is comparable to the education provided to non-disabled students.  Some students may have disabilities that substantially limit their participation in, or access to, school programs, yet do not need special education. These students may qualify for reasonable accommodations in the regular classroom under Section 504 of the Rehabilitation Act of 1973, and other Pennsylvania education regulations.

Wrightslaw provides comparisons of the IEP and 504.

If you believe that the School District has violated your child’s rights, see the Education Law Center’s brochure WHEN IS YOUR CHILD WITH A DISABILITY ENTITLED TO COMPENSATORY EDUCATION BECAUSE THE SCHOOL DISTRICT HAS VIOLATED HER RIGHTS?
